VIZPLUGINS End User License Agreement (EULA)
PEASE CAREFULLY READ THE FOLLOWING LICENSE AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS IN THIS AGREEMENT, DO NOT USE THIS PRODUCT OR ANY OF THE INCLUDED FILES.
GRANT OF LICENSE
1. GENERAL
This is a license agreement and not an agreement for sale. VIZPARK grants you a non-exclusive license to use this product, its software, documentation, bitmaps, scenes and 3d models for personal and commercial use in 3D related projects. The product itself as well as the copy the product or any other copy remains the property of VIZPARK at all times.
2. LICENSE GRANT
You may use this product, included software, content, files, scenes, models and documentation for the purpose of creating animations, images (renderings), games and visualizations.
3. RESTRICTIONS
YOU ARE NOT ALLOWED TO:
3.1 to resell, assign, publish or otherwise redistribute the product or any of its included files. Free products can be used for private or commercial use and can be modified in any way in order to conform to your needs. However, any such modifications or changes are still derivatives of the original and cannot be sold or distributed as your own.
3.2 Use of this product (in particular bitmaps, presets, materials) for the creation of a texture, material library or as a texture / material library for any kind of product, plug-in, 3d application or other graphics software is strictly prohibited. Individual bitmaps, scenes, materials or presets may not be distributed (commercially or otherwise) alone or in combination with other products. Furthermore these bitmaps, materials or presets may not be repackaged in whole or in part as texture libraries, material libraries, online in material databases or user communities.
3.3 Copy or use the product or documentation in another way than permitted by this Agreement.
4. COPYRIGHT
This product and VIZPARK are protected by German copyright law and international treaty provisions. You agree that no title to the intellectual property of the product or VIZPARK is transferred to you. You further acknowledge that title and full ownership rights to the product will remain the exclusive property of VIZPARK.
5. GOVERNING LAW
This agreement shall in all respects be governed by and construed in accordance with the laws in force in Germany.
6. TERM AND TERMINATION
This license agreement takes effect upon your use of the product and remains effective until terminated. You may terminate it at any time by destroying all copies of the product and included files or deleting all files and copies thereof from your harddisk. It will also automatically terminate if you fail to comply with any term or condition of this license agreement.
7. WARRANTY LIMITATIONS
MATERIAL MANAGER and MAXTILES are provided ´as is´ which means that you can use the software and its included materials for free, but VIZPARK will NOT provide support or cannot be held responsible for any damage that might result from the use of the software or any of the included parts. You can use Material Manager and the MaxTiles plugins for free, even in commercial 3D design related projects at your own risk. By installing and using these tools, you agree to these terms and the VIZPLUGINS EULA.
8. Other
If any provision of this Agreement is found to be invalid or otherwise unenforceable, the further conditions of this Agreement will remain fully effective and the parties will be bound by obligations which approximate, as closely as possible, the effect of the provision found invalid or unenforceable, without being themselves invalid or unenforceable.
BY INSTALLING AND AUTHORIZING THIS SOFTWARE, YOU HEREBY AGREE TO THE TERMS AND CONDITIONS PRESENTED ABOVE.
